Terms of Service

Article 1 (Scope)

These Terms of Service ("Terms") govern the use of QuizJam ("the Service"). The Service is provided at castgamingkit.com. By using the Service, you agree to be bound by these Terms.

Article 2 (Service Overview)

The Service is an interactive quiz presentation tool for live streamers. It integrates with OBS Studio to display and manage quizzes during live streams. Key features include:

• AI-powered quiz question generation and database-sourced questions
• OBS overlay and dock for quiz presentation
• Viewer comment integration (OneComme compatible)
• Listener quiz question submissions
• Dashboard for quiz management

Article 3 (Accounts)

1. Use of the Service requires OAuth authentication via Google or X (formerly Twitter).
2. Users are responsible for managing their own accounts.
3. The operator may suspend or delete accounts without prior notice if unauthorized use is detected.
4. Creating multiple accounts per user is prohibited.

Article 4 (Fees and Payments)

1. The Service offers a Free plan and a Pro (paid) plan.
2. Pro plan fees are based on amounts displayed within the Service.
3. Payments are processed through KOMOJU (DEGICA Co., Ltd.).
4. The Pro plan is a monthly subscription that auto-renews until cancelled.
5. Ticket purchases are one-time and non-refundable.
6. No prorated refunds are provided. After cancellation, the Service remains available until the end of the billing period.
7. Contracts for paid plans and tickets are formed directly between the operator (Takao Matsumoto, trade name: CastGamingKit) and the user.
8. The operator is responsible for all customer support, including inquiries, sales management, refund processing, and complaint handling.
9. The Pro Plan renews automatically each month. Charges will continue unless the user cancels. Cancellation is available at any time from the dashboard, and access remains until the end of the current billing period.

Article 5 (Prohibited Activities)

Users must not engage in the following activities:

• Activities that violate laws or public order
• Activities related to criminal conduct
• Placing excessive load on the Service's servers or network
• Interfering with the operation of the Service
• Collecting or storing personal information of other users
• Impersonating other users
• Unauthorized commercial use of the Service (resale, etc.)
• Providing benefits to or cooperating with antisocial forces
• Unauthorized access, scraping, or reverse engineering
• Submitting discriminatory, violent, sexual, or otherwise inappropriate quiz questions
• Submitting content that infringes on third-party copyrights, trademarks, or other intellectual property rights

Prohibition of Gambling Activities

This service is an entertainment quiz display tool and must not be used for gambling, wagering, or prize-giving activities. The following activities are prohibited:

• Wagering money or goods on quiz outcomes
• Offering prizes, rewards, or monetary compensation to quiz winners
• Using the service as a lottery, sweepstakes, raffle, or any other game of chance
• Reselling, transferring, or exchanging tickets for cash or other value

Prohibited Uses

The service must not be used for the following purposes:

• Providing or distributing adult content, sexually explicit material, or related services
• Engaging in or facilitating illegal activities
• Providing content that violates public order or morality
• Infringing on the rights of third parties, including copyrights, trademarks, or privacy
• Any other activity that we reasonably determine to be in violation of the above

Article 6 (User-Submitted Content)

1. Copyright of quiz questions submitted by users ("User Content") belongs to the submitting user.
2. Users grant the Service permission to use their submissions for Service operations and other users' streams.
3. Submitters are responsible for ensuring their content does not infringe on third-party rights.
4. The operator reserves the right to moderate submitted content.
5. Content deemed inappropriate may be removed without prior notice.
6. Users who repeatedly submit inappropriate content may have their submission privileges restricted.

Article 7 (Disclaimer)

7-1. Service Provision

The Service is provided "AS IS" without warranties of any kind. The operator makes no guarantees regarding the completeness, accuracy, reliability, or usefulness of the Service. The Service may be interrupted without notice due to server issues, maintenance, or third-party service outages.

7-2. AI-Generated Content

Quiz questions generated by the Service are created automatically by AI (large language models). AI-generated content may contain inaccurate or incorrect information. The operator makes no guarantees regarding the accuracy of AI-generated content. The operator is not liable for damages arising from errors in AI-generated content during streams.

7-3. Copyright and Intellectual Property Disclaimer

Quiz questions in the Service may reference anime, manga, games, movies, music, sports, literature, and other copyrighted works. All copyrights, trademarks, publicity rights, and other intellectual property rights related to work titles, character names, song titles, brand names, personal names, and other proper nouns mentioned in questions belong to their respective rights holders.

The Service has no affiliation, sponsorship, or endorsement relationship with any rights holders. References to copyrighted works in quiz questions are factual mentions within the scope of entertainment and education, with no intent to infringe on rights holders' rights.

If you are a rights holder and have concerns about content usage in the Service, please contact us and we will respond promptly.

7-4. Streaming Responsibility

Streamers bear full responsibility for the content of streams using the Service. The operator is not liable for damages to streamers or viewers arising from use of the Service, including but not limited to display issues during streams, boost feature malfunctions, or disputes related to viewer comments.

7-5. Third-Party Services

The Service utilizes the following third-party services. The operator is not liable for damages caused by outages, downtime, or specification changes of these services.

• Google LLC (OAuth authentication)
• X Corp. (OAuth authentication)
• Supabase Inc. (Database and authentication infrastructure)
• External payment processing service (Payment processing)
• Anthropic, PBC (AI question generation and content moderation)
• Vercel Inc. (Hosting)

7-6. Limitation of Liability

The operator's liability to any user is limited to the total amount paid by that user for the Service in the preceding 12 months. The operator is not liable for indirect damages, lost profits, data loss, or similar damages under any circumstances.

Article 8 (Service Changes and Termination)

The operator may change or terminate the Service without prior notice. However, for termination of paid plans, reasonable advance notice will be provided.

Article 9 (Changes to Terms)

The operator may modify these Terms as necessary. Modified Terms take effect upon posting on the Service. For significant changes, notification will be provided through in-service announcements.

Article 10 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. Any disputes relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
